Two Justice Department attorneys Chantel Febus and Michael Grant, along with Isaacs and his attorney Roger Diamond appeared at a hearing this week to determine whether Isaacs was qualified to give his opinion as an art expert in the case.
The judge questioned Isaacs on what kind of methodology he uses to establish a particular work has serious artistic merit.
Isaacs replied that his scat movies, which are the focus of his prosecution, have artistic merit because they have sparked discussion in various magazines and blogs.
The judge requested that Isaacs submit the articles for his review and will make a ruling in the next several weeks.
Isaacs has been charged with federal obscenity violations over the mail distribution of “Gang Bang Horse — ‘Pony Sex Game,’” “Mako’s First Time Scat” and “Hollywood Scat Amateurs No. 7.”
