FBI spokeswomen Laura Eimiller confirmed the arrest to the Reuters news service, but declined to make further comment because of the impending investigation in the case.
Investigative reporting site TheSmokingGun.comreported that Schmidt had been accused of attempting to sell a large portfolio of unpublished photos from the November 2006 wedding.
Cruise attorney Bert Fields confirmed to The Smoking Gun that Schmidt had approached representatives for the actor a year earlier and tried to sell them the cache of stolen photos. They immediately called in federal authorities.
Schmidt was in federal custody in Los Angeles, but according to information from the U.S. Bureau of Prisons website he was released on July 26.
