In today's hearing the court considered an 18-page evidentiary objection to statements by plaintiffs Kevin Cammarata and Paolo Cammarata filed by legal representatives of defendants Bright Imperial Limited.
The objections cite specific statements by the plaintiffs and raises objections to the statements on grounds including speculation, hearsay, lack of personal knowledge and improper opinion.
Cammarata's original lawsuit claims that RedTube has unlawfully offered free movies as loss leaders in an attempt to crush its competition and seeks to have RedTube shut down.
The suit also names Choopa LLC, which hosts RedTube from Sayreville, N.J., and RedTube advertisers — including BangBros.com; Utherverse, which owns RedLightCenter; Generation Financial, which owns Videosz.com; Fling.com; SexSearch; Lalib Limitada, which owns LiveJasmin.com; FriendFinder Networks and Brazzers — as defendants.
An attorney for Bright Imperial told XBIZ that he expected a ruling on the objections Monday.
